Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Artizia Yachts website, member dashboard, and yacht charter services (together, the "Services") provided by Artizia Yachts LLC ("Artizia Yachts," "we," "us," or "our"). By creating an account, applying for membership, or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 21 years old and legally able to enter binding contracts to use the Services. Membership is subject to application review and acceptance at our discretion.

2. Membership & fees

  • Memberships are offered at tiers (Executive, VIP, Platinum, Founders Circle), each with specified included hours, booking windows, and fees.
  • Initiation fees are non-refundable. Monthly or annual fees are charged in advance and are non-refundable except as expressly stated.
  • Included hours reset annually on your membership anniversary. Unused hours do not roll over.
  • Additional hours, overnight stays, and add-on services are billed at the rates posted in your member dashboard at the time of booking.
  • We may change pricing with at least 30 days' advance notice.

3. Reservations & cancellations

  • Reservations are subject to yacht availability, weather, captain's discretion, and applicable laws and regulations.
  • Cancellations made more than 72 hours before the start time receive a full hours refund. Cancellations within 72 hours forfeit included hours and any additional charges, except as required by law.
  • We reserve the right to cancel or reschedule reservations due to weather, mechanical issues, safety concerns, or force majeure. In such cases, you will receive a full hours refund but we are not liable for incidental expenses.

4. On-board conduct

  • The USCG-licensed Captain has final authority on all on-board decisions, including routing, weather-related adjustments, and passenger safety.
  • Illegal drugs are prohibited. Alcohol consumption is permitted for guests 21 and older, consistent with applicable law.
  • You are responsible for the conduct of your guests. Damage caused by you or your guests will be billed at replacement cost.
  • The Captain may terminate a charter early in case of dangerous or inappropriate conduct without refund.

5. Safety & liability

Yachting carries inherent risks. By participating, you acknowledge these risks and agree to follow all crew instructions. You may be required to sign a waiver before each charter. To the maximum extent permitted by law, Artizia Yachts's liability is limited to the amount you paid for the specific charter giving rise to the claim. We disclaim liability for indirect, incidental, or consequential damages.

6. Acceptable use of the platform

You agree not to:

  • Circumvent authentication or attempt to access accounts that are not yours.
  • Reverse-engineer, scrape, or data-mine the Services.
  • Interfere with the operation of the Services or other members' use.
  • Use the Services for any illegal purpose.

7. Intellectual property

All content on the site and dashboard — text, images, logos, software — is owned by Artizia Yachts or licensed to us. You receive a limited, non-transferable, revocable license to use the Services for their intended purpose. No other rights are granted.

8. Termination

We may suspend or terminate your access for violation of these Terms, non-payment, or conduct that endangers the safety or enjoyment of other members. You may cancel your membership at any time; cancellation takes effect at the end of the current billing period. Already-paid fees are not refunded on cancellation.

9. Disputes & governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. To the extent permitted by law, disputes will be resolved through binding arbitration on an individual basis, and you waive the right to bring or participate in a class action.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the site. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
